Containing 5.000 acres, more or less, as shown on plat of survey recorded in Deed Book 560, Page 964, with improvements thereon.
Subject to any and all covenants, conditions, restrictions, easements, and all other matters of record taking priority over the Deed of Trust, if any, affecting the aforesaid property.

TERMS OF SALE: CASH: A deposit of $20,000.00 or 10% of the sales price, whichever is lower, cash or certified check will be required at the time of sale, but no more than $9,000.00 of cash will be accepted, with settlement within fifteen (15) days from the date of sale. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In execution of a credit line deed of trust dated February 27, 2008, made by James Paul Holland, Jr. and Donna C. Holland, recorded in the Clerk’s Office of the Circuit Court for the County of Franklin, Virginia, as Instrument No. 080001765, Deed Book 932, page 718, the undersigned substitute Trustees, any or all of whom may act, will offer for sale on site at 370 Bethel Lane, Union Hall, VA 24176 (which is located directly across from 695 Bethel Lane, Union Hall, VA 24176), on October 4, 2014, at 10:00 o’clock a.m., property located in Franklin County, Virginia, which property is more particularly described as follows:
Tract One: All that certain tract or parcel of land, together with all appurtenances thereunto appertaining, CONTAINING 58.22 ACRES, more or less, lying in the Union Hall Magisterial District of Franklin County in the vicinity of old Bethel Church, and being further identified in the Franklin County land Records as Tax Map #53.-104 and being more particularly described as follows:
BEGINNING at a corner rock on the east side of a plantation road leading from Pokey Ann Hudson’s to County Route #674, thence leaving plantation road a westerly course about 100 yards to another corner rock planted; thence a westerly course through the woods about 400 yards to a corner rock in J. A. Brooks line, thence with his line a southerly or southeasterly direction about 500 yards to an apple tree, a corner of the line of J. A. Brooks; thence a southerly direction with the line of J. A. Brooks along wire fence about 150 yards to outlet to county road #673, thence out the outlet a southwesterly course about 200 yards to public road #673; thence an easterly course along the line of Mac Brooks, a wire fence, about 500 yards to a corner rock, thence with the old plantation road a northerly course about 600 yards to the place of BEGINNING;
TOGETHER WITH an outlet beginning where the description of the above property begins, which outlet is about 10 feet wide and runs in a northwesterly direction through property now or formerly owned by Clyde L. Holland and Christine Holland to Virginia Secondary Route 674; and
TOGETHER WITH an exclusive right of way, for the sole purpose of ingress and egress to the property hereinabove conveyed unto the Grantees, from State Secondary Route 834, and said right of way being twenty (20) feet in width and at all times adjoining the northern boundary line of the property heretofore conveyed unto Clyde Holland and Christine Holland by Deed dated April 8, 1946, and of record in the Clerk’s Office of the Circuit Court of Franklin County, Virginia, in Deed Book 105, Page 305 and being SUBJECT TO a reservation of the right to fence along the northern boundary line of the aforesaid right of way; and
Tract Two: All that certain tract or parcel of land lying on the easterly side of State Route 834 (Brooks Mill Road) in the Union Hall Magisterial District of Franklin County, Virginia, and being shown and described as TRACT A, 10.919 ACRES, on a Plat prepared by Philip H. Mundy, LS, for Donna C. Holland and J. Paul Holland, Jr., dated September 29, 2000, which plat is recorded in the Clerk’s Office of the Circuit Court of Franklin County, Virginia, in Deed Book 692, Page 890, and reference to which plat being hereby made for a more complete and particular description of the property conveyed; and
SUBJECT TO AND TOGETHER WITH a 50 foot easement along the northerly boundary and as shown on a Plat prepared by Philip H. Mundy, LS, for Donna C. Holland and James Paul Holland, Jr., dated May 8, 29, 2000, which plat is recorded in the Clerk’s Office of the Circuit Court of Franklin County, Virginia, in Deed Book 674, page 527; and
TOGETHER WITH a thirty foot easement along the southerly boundary and as shown on a Plat prepared by Philip H. Mundy, LS, for Donna C. Holland and James Paul Holland, Jr., dated May 8, 29, 2000, which plat is recorded in the Clerk’s Office of the Circuit Court of Franklin County, Virginia, in Deed Book 674, Page 527, and as set forth in the deed unto C. Edward Gillispie and Betty J. Gillispie of record in Deed Book 674, page 525.
This sale is subject to all easements, restrictions, conditions, and reservations of record affecting the title to the property hereinabove described.
The Substitute Trustees reserve the right to subdivide the property described above and sell such subdivided parcels according to the terms set forth herein and as announced at the sale.
Tract One is also subject to a first lien deed of trust dated December 15, 1998, securing Farm Credit of the Virginias, ACA, in the original amount of $91,000.00, which is recorded in the aforesaid Clerk’s Office in Deed Book 639, page 587. Upon a successful bid, the aforementioned deed of trust will be released by lender as to Tract One.
Tract One is also subject to a second lien deed of trust dated October 31, 2003, securing Farm Credit of the Virginias, ACA, in the original amount of $133,570.00, which is recorded in the aforesaid Clerk’s Office as Instrument Number 016130, Deed Book 803, page 1225. Upon a successful bid, the aforementioned deed of trust will be released by lender as to Tract One.
Employees, directors and officers of Farm Credit of the Virginias, ACA, and their immediate family and companies in which they have an interest are not eligible under federal regulations to purchase this property at foreclosure.
TERMS OF SALE: Cash. A bidder’s deposit of up to ten percent (10%) of the successful bid in cash or certified funds may be required. Settlement within thirty days of sale. Additional terms may be announced at the time of sale. The successful bidder will be required to execute a Memorandum of Trustee’s Sale outlining additional terms of sale and settlement which will be available for review prior to the announcement of sale.
