IN EXECUTION OF A DEED OF TRUST made by Archie Thomas Musgrove, dated June 30, 2010 securing payment of a note in the original principle amount of $100,000.00, and recorded in the Franklin County Circuit Court Clerks Office in Deed Book 981, at Page 2730, default having been made in the payment of the note thereby secured and at the request of the noteholder, the undersigned sole acting trustee will offer for sale at public auction that certain tract or parcel of land containing 1.474 acres and described as Lot 7 of Black Rock Meadows according to that plat dated August 28, 2008 made by Robert C. TERMS OF SALE:
1. Closing shall occur on or before the 20th day following the sale date above referenced and time is of the essence.
2. The full purchase price will be due by wire transfer of immediately available federal funds, cashiers check, certified check, or cash money.
3. The property will be conveyed by Trustees Deed with Special Warranty of Title.
4. A bidders deposit in the amount of ten percent (10%) of the successful bid will be required and must be in cash, certified bank check, or check pre-approved by the Sole Acting Trustee. If the successful bidder fails to complete settlement, the deposit shall be forfeited and the Trustee may resell the property at the risk and at cost of the defaulting purchaser.
5. Real estate taxes will be prorated through the date of sale and the purchaser will be responsible for the payment of such taxes beginning the day immediately after the public auction.
6. Seller will be responsible for preparation of deed and payment of Grantors Tax and all other closing costs including, but not limited to, title research, title insurance, and buyers recording costs will be borne by the buyer.
7. Closing will be subject to confirmation that borrower did not file for protection under the US Bankruptcy Code. If closing does not occur, buyers sole remedy against noteholder and Trustee will be return of deposit made at the sale.
8. Neither the Sole Acting Trustee nor the noteholder will be responsible for obtaining possession of the premises for the buyer.
