Trustee's Sale 347 Sandlewood Road, Wirtz, VA 24184 (Parcel ID: 0290005401) Default having been made in the terms of a certain Deed of Trust dated August 15, 2006, in the original principal amount of $405,410.40 and recorded in the Clerk's Office of the Circuit Court of the County of Franklin, Virginia on September 25, 2006, in Deed Book 0894, at page 01361, the undersigned Substitute Trustees will sell at public auction on February 3, 2021 at 2:00 PM, in front of the building housing the County of Franklin Circuit Court, 275 South Main Street, Rocky Mount, VA 24151, the property designated as all that certain tract or parcel of land, situate, lying and being in the Gills Creek Magisterial District, Franklin County, Virginia, and being more particularly shown and described by plat of survey prepared by Philip H. Mundy, L.S., dated May 8, 2002, (JOB NO. 3540), and being described thereon as follows, to-wit: BEGINNING at an iron pin, situate, in the southwestern most boundary line in the grantee`s adjoining property, thence, a new line, with an existing fifty (50) foot right of way, N. 81 degs. 00` 00" W. 250 feet to an iron pin set, thence, a new line, leaving the said access right of way N. 08 degs. 58` 51" E. 174.26 feet to an iron pin set, thence, a new line, S. 81 degs. 00` 00" E. 250 feet to an iron pin found, thence, and with the boundary line of the Grantee`s adjoining property, S. 08 degs. 58` 51" W. 174.26 feet to the place of BEGINNING, and containing 1.000 acre. Together with a right of way and easement traversing over, across and along the existing fifty (5) foot right of way upon which the subject parcel is situate, and leading unto Virginia Secondary Route 997 (Saddlewood Road). Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises. TERMS: CASH. A deposit of $40,000.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder's deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee's Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee's Sale, available for review upon request before the sale, outlining additional terms of sale and settlement.
